Terms of Service
Last updated October 7, 2026
These Terms of Service ("Terms") are an agreement between you and Ash Software LLC ("we," "us," or "our") and govern your use of GalleryShare, including our website at https://galleryshare.app, the GalleryShare capture app, the in-store slideshow, and customer galleries (together, the "Services").
By creating an account, or by using the Services in any other way, you agree to these Terms and to our Privacy Policy. If you are accepting these Terms on behalf of a business, you confirm that you are authorized to bind that business, and "you" means that business. If you do not agree to these Terms, do not use the Services.

Table of contents
1. Who may use the services
In Short: Store accounts are for businesses and adults. Customers can view the gallery a store shares with them without an account.
The Services are used by two kinds of people. Stores are businesses that create an account to capture, organize, and deliver event photos and videos. Customers are the people a store shares a gallery with. Customers do not need an account and view a gallery using the access key or link the store gives them.
You must be at least 18 years old to create a store account. Store accounts are for business use, and you may not create one if we have previously suspended or terminated your account, or if you are barred from using the Services under applicable law.
Customers who view a gallery agree to use it only to view and download their own event photos and videos, and to follow Section 3.
2. Store accounts and responsibilities
In Short: Keep your account details accurate and secure. You are responsible for what happens under your account and for your relationship with your customers.
- Accurate information. You must give us accurate account information, including a working email address, and keep it up to date. You must verify your email address before signing in. We may require new accounts to be approved before they can be used.
- Security. You are responsible for keeping your password confidential and for every device you sign in to, including devices you sign in to the capture app or the in-store slideshow. Tell us promptly at support@ashsoftware.dev if you believe your account has been accessed without your permission.
- Activity under your account. You are responsible for all activity under your account, including by your staff, and for their compliance with these Terms.
- Your customers. Your relationship with your customers is between you and them. You are responsible for deciding who receives an access key, for telling customers how long their media will be available (see Section 6), and for any promises you make to them about their photos and videos.
3. Acceptable use
In Short: Only upload event photos and videos you have the right and consent to share. Never upload illegal or harmful content.
Rights and consent. Before you upload, display (for example on an in-store slideshow), or share any photo or video, you are responsible for having all rights, licenses, and consents needed to do so, including the consent of the people who appear in it (and of a parent or guardian for any minor who appears in it) where the law requires it.
You agree not to use the Services to upload, store, or share:
- Child sexual abuse material (CSAM) or any content that sexually exploits or endangers minors. We report apparent CSAM to the National Center for Missing & Exploited Children and to law enforcement as required by law.
- Content that is illegal, or that you do not have the right to share, including content that infringes anyone's copyright, trademark, privacy, publicity, or other rights.
- Intimate or sexual images of a person shared without their consent, or content that harasses, threatens, or defames anyone.
- Malware, viruses, or any other harmful code or files.
You also agree not to:
- Use the Services as general file hosting, backup, or a content delivery network, or for anything other than delivering event photos and videos to your customers.
- Try to get around upload limits, billing, or the free trial, for example by creating multiple accounts.
- Guess, collect, or share access keys or links to galleries that were not shared with you.
- Interfere with, disrupt, overload, or probe the Services or our infrastructure, or access them by automated means other than the interfaces we provide.
- Resell or sublicense the Services without our written consent.
Each event may hold up to 150 photos and 20 videos. Each photo may be up to 50 MB and each video up to 500 MB. We may change these limits.
We do not review content before it is uploaded, but we may remove any content, and suspend any account, that we believe breaks these Terms or the law.
4. Your content and the license you give us
In Short: You keep ownership of what you upload. You give us only the permission we need to run the Services.
As between you and us, you (or your licensors) own the photos, videos, and other content you upload ("Your Content"). We do not claim ownership of it.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, and display Your Content, only as needed to provide, secure, and support the Services, including serving it to anyone who has the gallery's access key or a link to the media. This license ends when Your Content is deleted from the Services, except for copies we must keep to comply with the law.
You represent that you have the rights needed to grant this license, and that our use of Your Content as permitted by these Terms will not infringe anyone's rights.
The Services themselves, including our software, design, and the GalleryShare name and logo, belong to us. These Terms do not give you any rights to them other than the right to use the Services as described here.
5. How galleries are shared
In Short: Galleries work like a shared link. Anyone who has the access key or a media link can view the photos and videos.
Each event has an 8-character access key. Anyone who enters the key, or follows a gallery link sent from the store, can view and download that event's photos and videos. Each photo and video is also served from a public web address. Anyone who has that address can view the file without an access key or an account.
Access keys and links can be forwarded, so a customer can share their gallery with friends and family, and anyone they share it with can share it further. We cannot control who a key or link is passed to, and once someone has downloaded a file, we cannot take that copy back. A store can issue a new access key for an event, but this does not change the web addresses of media files that someone already has.
Do not use the Services for photos or videos that must stay restricted to particular people.
6. Retention and deletion
In Short: Photos and videos are permanently deleted 120 days after upload. We do not keep backups. Download anything you want to keep.
- 120-day retention. Each photo and video is automatically and permanently deleted 120 days after it is uploaded. After that, the event and its gallery are removed from our records. Stores should tell customers to download their photos and videos promptly.
- No backups. We do not keep backups of photos or videos. Once a file is deleted, for any reason, we cannot recover it. The Services are not an archive, and you are responsible for keeping your own copies of anything you want to keep.
- Deleting an event. When a store deletes an event, we delete its photos and videos from our storage and its gallery stops working.
- Deleting your account. When you delete your store account, we delete your account, events, and access keys. Photos and videos already uploaded remain in storage, and viewable by anyone who has their web address, until they reach the end of their 120-day period. To remove media sooner, delete the events before you delete your account. Your account can only be deleted once your balance is settled (see Section 7).
- Copies outside our control. Copies that people have downloaded, and copies saved temporarily by browsers or networks, are not affected by any deletion.
Our handling of personal information, including account information, is described in our Privacy Policy.
7. Fees and billing
In Short: Your first 5 events are free. After that, you pay $2 for each gallery the first time a customer redeems it, billed monthly through Stripe.
- Free trial. The first 5 events a store creates are free, and no credit card is required. Their galleries are never charged, even after you subscribe. Deleting an event does not give you another free event.
- Subscription. To create more than 5 events, you must subscribe and add a payment method. Payments are processed by Stripe. The subscription has no upfront or seat fee.
- Metered charges. We charge $2 for each event gallery the first time a customer redeems it. A gallery is redeemed the first time anyone views it using its access key or email link. Each gallery is charged once, no matter how many times it is viewed, how many people view it, or whether its access key is replaced. A gallery that is never redeemed is not charged.
- Invoices and payment. Charges are billed monthly on an invoice and charged automatically to your payment method on file. You authorize us, through Stripe, to charge that payment method for all fees you owe. You can view usage on your billing page and manage your payment method and invoices through the billing portal.
- Unpaid balances. If a payment fails, you remain responsible for the amount owed. We may retry the charge, and we may limit or suspend your account, including your ability to create events, until the balance is paid.
- Canceling. You can cancel your subscription at any time from the billing portal or by contacting us. Charges for galleries redeemed before the cancellation takes effect remain payable.
- Deleting your account. Before your account is deleted, any outstanding invoices are charged, your subscription is canceled, and a final invoice for your remaining usage is charged. Your account cannot be deleted while any amount is unpaid. If a gallery was redeemed within the last hour, you may need to wait before deleting your account so that its charge can be included in your final invoice.
- Price changes. We may change our prices. We will give you notice before a price change applies to you, and it will not apply to galleries redeemed before it takes effect.
- Refunds and taxes. Except where required by law, fees are non-refundable. Fees do not include taxes, and you are responsible for any taxes that apply to your purchases.
If you believe you have been charged in error, contact us at support@ashsoftware.dev.
8. Suspension and termination
In Short: You can stop using the Services at any time. We can suspend or close accounts that break these Terms or put others at risk.
You may stop using the Services and delete your store account at any time from your profile page, subject to the billing rules in Section 7.
We may suspend or terminate your account, disable access keys or galleries, or remove content, with or without notice, if we reasonably believe that you have broken these Terms, that your use creates legal, security, or financial risk for us, our users, or others, that you have not paid amounts you owe, or that we are required to do so by law. We may also stop offering the Services, and if we do, we will try to give you reasonable notice.
If your account is suspended or terminated, you still owe any fees incurred before then. Sections 4 (the parts about ownership), 7 (for amounts owed), and 11 through 16 continue to apply after your account ends.
9. Copyright complaints and takedowns
In Short: If you believe content on GalleryShare infringes your rights, tell us and we will review it.
To report content you believe infringes your copyright, email support@ashsoftware.dev with:
- the work you believe is infringed;
- the gallery or media link where the infringing content appears;
- your name and how to reach you; and
- confirmation that you own the copyright or are authorized to act for the owner, and that your report is accurate to the best of your knowledge.
We review every report and remove content that infringes. If your content was removed and you believe that was a mistake, reply to us at the same address and we will take another look. We may terminate the accounts of repeat infringers.
To report other content that breaks these Terms, such as content uploaded without consent, email support@ashsoftware.dev with the gallery or media link. If you believe content shows the sexual exploitation of a child, also report it to the NCMEC CyberTipline.
10. Third-party services
We rely on third-party providers to run the Services, including Stripe for payments and cloud providers for hosting and storage. Your use of Stripe is also subject to Stripe's terms. We are not responsible for third-party services that we do not control.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT UPLOADS WILL ALWAYS SUCCEED, OR THAT ANY CONTENT WILL BE STORED OR REMAIN AVAILABLE. YOU ARE RESPONSIBLE FOR KEEPING YOUR OWN COPIES OF YOUR CONTENT.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, CONTENT, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. THIS INCLUDES THE LOSS OR DELETION OF PHOTOS AND VIDEOS, AND THE VIEWING OF CONTENT BY ANYONE WHO HAS AN ACCESS KEY OR LINK.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow some of these exclusions or limits, so some of them may not apply to you.
13. Indemnification
If you use the Services as a store, you agree to defend, indemnify, and hold harmless Ash Software LLC and its members, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of Your Content, your use of the Services, your relationship with your customers, or your breach of these Terms or of anyone's rights, including a claim that you did not have the rights or consent needed to upload or share a photo or video.
14. Changes to these terms
We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date at the top of these Terms. If we make material changes, we will notify store accounts by email or by a notice in the Services before the changes take effect. If you keep using the Services after the changes take effect, you agree to the updated Terms. If you do not agree, you must stop using the Services and may delete your account.
15. Governing law and disputes
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, and you and we consent to the personal jurisdiction of those courts.
Before filing a claim, you agree to first contact us at support@ashsoftware.dev so that we can try to resolve the dispute informally.
16. General
These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Services. If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. You may not transfer these Terms or your account without our written consent. We may transfer these Terms in connection with a merger, acquisition, or sale of assets.
17. How can you contact us?
If you have questions about these Terms, you may email us at support@ashsoftware.dev.
